U.S (NATIVE ORGANIZERS ALLIANCE) : VICTORY for Native communities and Tribal sovereignty !

Today is a victory for Native communities and Tribal sovereignty. The Supreme Court’s decision to uphold protections under the Indian Child Welfare Act (ICWA) respects the rights of sovereign nations to make decisions about the well-being and care of their youngest Tribal citizens.

After decades of the forced removal of our Native children from their homes, this is a small win in the larger fight to maintain Tribal sovereignty and cultural continuity for generations to come.

While today’s victory is to be celebrated, this will not be the last time a case against Tribal rights will be brought to the courts. Native Organizers Alliance will continue to hold governments accountable for protecting and upholding our sovereignty.

While Native Organizers Alliance, along with 497 Tribal Nations, 62 Native-led organizations, 23 states and DC, as well as members of Congress and child welfare organizations were successful today in Haaland V. Brackeen, this case is part of a larger campaign to undermine Tribal sovereignty to set a precedent that eventually guts the legal infrastructure that codifies Tribal sovereignty.

That’s why, even as we fight in the courts to protect our rights, we are also organizing Native communities across the country. Your activism has already resulted in 13 states codifying ICWA into law, protecting Native communities and children if ICWA was to ever be overturned by the courts. It also reflects that the highest court in the land understands that Tribal sovereignty isn’t just an inherent right, it’s a right guaranteed by the Constitution.

ICWA has protected Native children, ensuring their ongoing sense of community and cultural identity by prioritizing keeping them with family (including extended family) or members of their Tribe. Keeping children within their communities and connected to their culture is a child welfare practice that should be expanded, not eliminated.

From attacks on ICWA to attacks on our land and resources, we are not sitting by as opponents, funded by the fossil fuel extractive industries, try to dismantle our sovereignty, destroy our lands and harm our children.
