President Biden just nominated Judge Ketanji Brown Jackson to the Supreme Court—but Republicans are already previewing tactics they may use to block Judge Jackson’s confirmation.
GOP senators have been boycotting committee meetings in an attempt to stop several key Biden nominees from moving forward to a full Senate vote, leaving agencies including the Federal Communications Commission and Federal Trade Commission deadlocked.
Now Senator Thom Tillis is saying the Republicans are prepared “to use all the devices we have” to block any Supreme Court nominee they don’t like—and they’re already criticizing Judge Jackson. Senate leadership cannot continue to let Republicans bring the democratic process to a halt.
Demand Progress spotted this trend early and responded to it. Now we're calling for the Senate to fix existing rules so Republicans can no longer block votes on nominees. Republicans have been delaying committee confirmation votes for key agencies like the FCC and the FTC for months. We finally helped get the FCC and FTC nominees out of committee, but these blockade tactics have been so effective that a nominee for the Small Business Administration withdrew from consideration. Republicans also boycotted a vote on Federal Reserve nominee Sarah Bloom Raskin, who has pledged to focus on how climate change is affecting the economy.
The current interpretation of Senate rules is that a majority of a committee must be present before a nominee can move, but the committees are split evenly between Republicans and Democrats, so Republicans are just . . . not showing up. A Senate majority can address the rules to ensure this tactic is no longer available to Republicans.
Sen. Tillis’ comment is a thinly veiled threat : they may go all out to block a vote on Ketanji Brown Jackson.
After pushing extremist Justices Amy Coney Barrett and Brett Kavanaugh onto the Court, Republicans cannot be allowed to block Judge Jackson, a federal appellate judge and a former public defender.
Senate Democrats need to correct the understanding of the rule in order to take away one tool the Republicans are attempting to use to block Biden’s nominees.
