On April 7, the U.S. Senate confirmed Ketanji Brown Jackson as the next Associate Justice of the Supreme Court. The first Black woman and former public defender to join the highest court, Justice Jackson’s vision for equal justice for all will undoubtedly permeate court decisions that impact those who have seen themselves excluded from the bench for too long.
However, with a 6-3 ultra-conservative supermajority on the Supreme Court bench, Justice Jackson will surely face an uphill battle. We must continue working to ensure her tenure on the Supreme Court is marked by majority opinions that affirm everyone’s inherent human rights, and we can do so by urging Congress to expand the Supreme Court.
In 2021, Reps. Mondaire Jones, Hank Johnson, and Jerry Nadler and Sen. Ed Markey introduced the Judiciary Act, legislation that would expand the Supreme Court from nine seats to thirteen. With the rapid decimation of our democracy and fundamental rights like abortion access and the freedom to vote—and Republicans at the national, state, and local levels only increasing such attacks—Congress must quickly act to pass the bill. The United States doesn’t look how it did when the court was founded in 1789, nor does it look how it did in 1869 when Congress last changed the number of justices on the bench to nine. Adding four seats to the bench now is simply the right thing to do. It’s the practical, proportional answer to Republican theft of the Supreme Court, and it reflects the needs of a changing, evolving nation.
Expanding the Supreme Court isn’t only about playing defense to respond to the erosion of our democracy. It’s also about building something that works for all of us, not just the privileged and powerful—and that’s something every single U.S. senator and representative should support. Our message to Congress :
Justice Ketanji Brown Jackson’s historic confirmation is a crucial first step to rerouting the deeply troubling, anti-democracy path the Supreme Court has taken—but we still have work to do. Pass the Judiciary Act of 2021 to expand the Supreme Court.
